Applicable legislation: Income-tax Act, 2025 and Income-tax Rules, 2026
The Income Tax Department has specifically listed 7 September 2026 as the due date for depositing tax deducted/collected for August 2026.
Rule 218 – Time and Mode of Payment
With the Income-tax Act, 2025 and Income-tax Rules, 2026 applicable from 1 April 2026, the relevant payment provisions are contained in Rule 218 of the Income-tax Rules, 2026.
For deductors or collectors other than an office of the Government, tax deducted or collected during a month is generally required to be paid to the credit of the Central Government on or before the seventh day from the end of that month. Rule 218 prescribes the applicable timelines and also contains specific exceptions for certain challan-cum-statement transactions.
Special Rule for Government Offices
Government offices have an additional compliance requirement. Under Rule 218(1):
-
Where tax is paid without production of an income-tax challan, the amount must be credited to the Central Government on the same day.
-
Where tax is paid along with an income-tax challan, it must generally be paid on or before seven days from the end of the month in which the deduction or collection is made.
The same-day requirement is particularly relevant for government offices making payment through book adjustment rather than through a conventional income-tax challan. The Income Tax Department has also clarified that government offices can remit such amounts through book adjustment.
TDS Framework Under the Income-tax Act, 2025
For tax deducted during the tax year beginning 1 April 2026, the TDS provisions are contained principally in Sections 392 and 393 of the Income-tax Act, 2025.
Section 392 deals with TDS on salaries, while Section 393 provides the framework for TDS on various other specified payments. The Income Tax Department has stated that the new Act largely retains the existing TDS/TCS policy while consolidating and simplifying the provisions.
Compliance Checklist
Before the due date, deductors and collectors should:
-
Reconcile TDS/TCS deducted or collected during August 2026.
-
Verify the applicable section, rate and amount.
-
Ensure timely payment to the Central Government.
-
Government offices should specifically determine whether payment is being made through book adjustment or with an income-tax challan.
-
Maintain appropriate records and payment details for subsequent TDS/TCS reporting and reconciliation.
Conclusion
The general deadline for depositing TDS/TCS relating to August 2026 is 7 September 2026. Government offices should take particular care where tax is deposited without an income-tax challan, as Rule 218 requires such tax to be credited to the Central Government on the same day.
Timely deposit is an essential part of tax compliance and helps avoid interest and other consequences arising from delays.
